What to Do After a Visa Refusal

A refusal is not the end of the road, but what you do next depends on the reasons and the type of visa. The worst move is to reapply straight away with the same file, because the result will probably repeat.

This guide explains what official sources say about appeals and reapplying for Schengen and US visas, and how to review your file. No office can guarantee that a new application will be approved, because the embassy makes the decision.

Is your file ready to submit?

Most refusals come from one small detail in the file. Send us your destination and travel dates and we will review your documents before you apply.

Read the Refusal Letter and Its Reasons First

For Schengen, the refusal and its reasons must be notified using the standard form in Annex VI of the Visa Code (Article 32). The same article lists the grounds for refusal, including insufficient means of subsistence, doubts about the authenticity of documents or the reliability of statements, missing travel medical insurance, or a purpose of stay that is not justified.

For the US, the refusal is explained by the section of law used. The most common is section 214(b) of the Immigration and Nationality Act, which means the applicant did not show they qualify for the visa category or did not show enough ties to their home country. Keep the form or letter, because you will need it for any later step.

Appeal Versus Reapplying

For Schengen, the form must include information on the appeal procedure, and the authority and deadline vary by country. Read what is written on your own refusal form rather than relying on a deadline you heard from someone else.

Correct the File Before Reapplying

Go through every reason in the refusal, compare it with your documents, and fix what can genuinely be fixed. These are examples of what we review at Almorad.

Wait or Reapply Immediately?

In the official sources we reviewed we found no set waiting period for reapplying for a Schengen tourist visa, so follow what your refusal form says. The US State Department says you can reapply if circumstances have changed after a 214(b) refusal, and it stresses showing a significant change since the last application.

The practical rule is to reapply once something real has changed in your file, not before. Reapplying immediately with no change is what to avoid.

Declaring a Previous Refusal

Answer every question about your visa history truthfully. The US State Department warns that any false or misleading statement may result in permanent refusal of a visa or denial of entry. Keep a copy of your refusal letter so you can check its dates and reasons before filling in any new form.

We cannot promise approval after a refusal. Stay away from any office that promises a guaranteed visa, or suggests altering a document or hiding a previous refusal.

Frequently Asked Questions

Can I appeal a Schengen visa refusal?

Yes. Article 32 gives refused applicants the right to appeal, against the Member State that took the decision and under its national law. The authority and deadline are on the refusal form.

Can I appeal a US 214(b) refusal?

The State Department does not describe an appeal route. It describes submitting a new application if you have additional information or your circumstances have changed.

Should I mention the previous refusal in my new application?

Answer the form's questions truthfully and as they stand, and do not hide anything from your record. Concealment can cause a bigger problem than the refusal itself.

How long should I wait before reapplying?

We do not state a period we have not verified in an official source. What matters is that something real changes in your file or circumstances before you apply again.

Can I apply to another country after a Schengen refusal?

You can, but first understand the reason for the refusal. Also read the difference between visa types.
