How is a refusal notified, and what are the official grounds?

Article 32 of the EU Visa Code says the decision and its reasons are notified on a standard form (Annex VI), in the language of the Member State that decided and another official EU language. The European Commission explains that refused applicants receive the reason for refusal and how to submit an appeal.

The form lists the grounds, and the ones that apply to your case are ticked. The grounds most relevant to a tourist file are in the table below, with how to avoid each.

Grounds that documents alone cannot fix

The list also includes grounds that relate to your situation rather than your documents, such as an alert in the Schengen Information System (SIS) for refusing entry, or one or more Member States considering you a threat to public policy, internal security, public health or international relations. Improving the file does not resolve these.

Appeal basics after a refusal

Article 32 gives every refused applicant the right to appeal. The appeal is brought against the Member State that took the final decision and under its national law, and Member States must give you information on the procedure to follow.

The refusal form states which authority an appeal goes to and the time limit, which is why we give no single deadline here. Read the form you received carefully, and see what to do after a visa refusal to decide between appealing and correcting your file.

Under Article 32, information on a refused visa is entered into the Visa Information System (VIS). Address the reason for refusal before any new application rather than simply reapplying with the same file.

How do I find out why my visa was refused?

The embassy gives you the standard refusal form, which ticks the grounds the decision relied on and may add remarks. Go back to it before any next step.

Can I appeal a Schengen refusal?

Yes, Article 32 gives you that right. The appeal is brought under the national law of the country that refused the application, and the procedure is explained on the refusal form.

How long does the decision take?

It normally takes 15 days and can reach 45 days in cases that need closer examination, according to the European Commission.

Is approval guaranteed if my file is complete?

No. According to the French visa portal, even a complete file does not guarantee a visa, and the decision rests with the consulate.
